Terms and Conditions

Welcome to Web Minds Design! Before you engage our services, we kindly ask you to carefully review the following terms and conditions. These terms outline the agreement between Web Minds Design (referred to as “we,” “us,” or “our”) and you (referred to as “you” or “client”). By using our services, you agree to comply with and be bound by these terms and conditions.

1. Payment Terms:

1.1 Payment Schedule: Payment for our services will be made in three installments, as follows:

• Initial Payment: One-third (1/3) of the total project cost is due at the beginning of the project, before any work commences.

• Mid-Project Payment: An additional one-third (1/3) of the total project cost is due at the midpoint of the project timeline, as mutually agreed upon by both parties.

• Final Payment: The remaining one-third (1/3) of the total project cost is due upon completion of the project and before the final deliverables are transferred to the client.

1.2 Late Payments: Failure to make timely payments may result in project delays or termination at the discretion of Web Minds Design. Late payments may also incur additional fees or interest charges.

2. Project Timeline:

2.1 Agreed Timeline: The project timeline will be mutually agreed upon by Web Minds Design and the client before the commencement of any work.

2.2 Client Responsibilities: Any delays in project completion caused by the client, including but not limited to providing necessary materials or feedback, may result in adjustments to the project timeline and additional costs, if applicable.

3. Project Scope:

3.1 Scope Definition: The scope of the project, including deliverables and milestones, will be defined in writing and agreed upon by both parties before the commencement of any work.

3.2 Changes to Scope: Any changes or additions to the project scope requested by the client may result in adjustments to the project timeline and additional costs, if applicable. Such changes must be agreed upon in writing by both parties.

4. Intellectual Property:

4.1 Ownership: Upon receipt of full payment, the client will own the intellectual property rights to the final deliverables produced by Web Minds Design for the specified project.

4.2 Portfolio Rights: Web Minds Design retains the right to showcase the completed project in its portfolio and marketing materials, unless otherwise agreed upon with the client.

5. Refund Policy:

5.1 Refund Consideration: Refunds will be considered on a case-by-case basis.

5.2 Non-Refundable Payments: If the project is terminated by the client before completion, any payments made up to that point are non-refundable.

5.3 Satisfaction Guarantee: In the event of dissatisfaction with the final deliverables, the client must notify Web Minds Design within 14 days of delivery to discuss potential revisions or refunds.

6. Confidentiality:

6.1 Confidentiality Agreement: Web Minds Design agrees to keep all client information and project details confidential unless otherwise agreed upon in writing.

7. Governing Law:

7.1 Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

9. Consultation fee:

For professional consultations, we have instituted a fee of 150€ to ensure dedicated and tailored expertise for your project’s initial assessment. Recognizing the value of continued collaboration, should you choose to advance your project with us, this consultation fee will be seamlessly integrated as a credit towards your first invoice. This policy underscores our commitment to fostering productive partnerships and delivering exceptional value to our clients.

By engaging in a professional consultation with us, you agree to these terms and conditions regarding the consultation fee. This fee is non-refundable unless otherwise agreed upon in writing by both parties. Additionally, any further engagements or services provided beyond the initial consultation will be subject to separate terms and pricing agreements.

9. Amendments:

8.1 Updates: Web Minds Design reserves the right to update or modify these terms and conditions at any time without prior notice. Continued use of our services after any such changes shall constitute your consent to such changes.
